Legal
Terms of treatment
This is a translation for your convenience. Only the German version is legally binding.
1. What do you need before treatment starts?
1.1. Doctor’s referral
For your treatment you need a doctor’s referral (ärztliche Verordnung). You can get it from a doctor of your choice who is authorised to issue it. In addition to your personal details, the referral must contain
- a medical diagnosis,
- the number of treatment sessions and
- the prescribed treatment.
Without a doctor’s referral you can only use my services for prevention. By professional law, preventive services may only be provided to healthy people. If, for example, you are in pain or you know of or develop any other condition that requires treatment, please tell me immediately.
1.2. Billing of treatment costs
The cost of treatment is based on a combination of the individual service, the time required and any material needed for the treatment, and will be communicated to you when treatment starts. I have no contract with your health insurance provider. As an independent therapist (Wahltherapeutin) you pay me directly and then apply to your health insurance provider for a partial refund according to the insurance tariff or statutory subsidy. Any information about the expected refund or subsidy is subject to the decision of your social insurance provider.
1.3. Approval by your health insurance provider’s chief medical officer
Your health insurance provider covers part of the treatment costs. For this, the doctor’s referral must be approved by the chief medical department (chefärztliche Bewilligung) of your health insurance provider. With this approval the provider agrees to refund its share of the costs or the statutory subsidy once the treatment has been carried out and paid for, on the basis of the invoice submitted together with the approved referral.
1.4. Medical reports
Proper treatment requires a thorough initial assessment, for which I rely on your help. Please bring all relevant medical reports to your first appointment.
2. How does the therapy work?
2.1. Personal one-to-one care
For the duration of the treatment I am there exclusively for you. I am your contact for all organisational and professional questions about the treatment.
Together we agree on the points that matter to you, such as …
- Where to? → treatment goal
- What? → treatment measures
- When? → appointments
- How long? → duration of each session
- How often? → frequency of treatment
- Until when? → scope of treatment
- How much? → cost of treatment
2.2. Your treatment
My services include all measures carried out directly with and for you, in particular
- personal, individual treatment including assessment and advice
- treatment-related administration and scheduling
- preparation and follow-up required for the treatment, e.g. making, adapting and providing individual therapy material
- documentation (medical record) and its storage for 10 years; you have the right to inspect it and obtain a copy (for a fee)
- if needed or on request: writing individual reports beyond the documentation for submission to health insurance providers, treating doctors, private insurers and similar bodies
By signing after each session you confirm that you received the treatment. This is required for your health insurance provider to cover its share of the costs.
2.3. Principles of treatment
- Law: Treatment is provided in accordance with the relevant legal provisions, in particular the Austrian Federal Act on the Higher Medical-Technical Services (MTD-Gesetz) as amended.
- Science: I follow current scientific evidence.
- Self-determination: Based on the doctor’s referral and the initial assessment I suggest a treatment plan. It is up to you to accept it or to agree on changes with me.
- Confidentiality: All information you give me is subject to professional confidentiality. It is assumed that you want information to be exchanged with the referring doctor and with other health professionals you name who are involved in your treatment, in order to optimise it. This information will not be passed on to anyone else against your will. If passing on further information appears useful and necessary for medical or therapeutic reasons, I will discuss this with you. The same applies to passing on documentation that is required by law.
2.4. Documentation
I am required by law to document, among other things, the therapeutic measures in a medical record. After the treatment ends, the documentation remains with me and is kept for the legally required period of 10 years.
3. What should you know about the cost of treatment?
3.1. Amount
The cost is based on a combination of the individual service, the time required and any material needed for the treatment. I will tell you the cost of the planned treatment at the start, and current prices are shown on my website.
3.2. Payment
At the end of the treatment (or of the sessions covered by the doctor’s referral) I will issue an invoice for the total cost of the sessions. You can agree with me on the following payment methods:
- cash
- payment slip or bank transfer
We agree on the due date together; it is stated on the invoice. If you are late with the agreed payment, I reserve the right to charge default interest at the statutory rate of 4 %.
Reminder fees for invoices not paid by the due date are € 15 for the first reminder, € 25 for the second and € 35 for the third. The total cost of treatment therefore consists of the invoice amount plus any default interest and reminder fees.
4. What is your part in successful treatment?
I accompany you on your very personal path and support you with advice and practical help. During the initial assessment we discuss and agree on the treatment goal and measures. Successful treatment requires you to tell me about your state of health, the examinations and treatments related to your current complaints, and any you have had so far. I will help you with targeted questions.
Your cooperation is essential for the best possible result. This may mean following certain instructions, repeating exercises you have learned or avoiding certain activities.
If I get the impression that the treatment goal cannot be reached, for example because of a lack of cooperation, I will talk to you about it and try to offer a solution.
5. How do you cancel an appointment?
If you cannot attend an agreed appointment, please let me know immediately, and no later than 24 hours before the appointment on a working day. Otherwise I reserve the right to charge for the missed appointment the amount you would have paid if the treatment had taken place. These costs cannot be claimed from your health insurance provider.
6. When does treatment end?
The doctor’s referral limits the scope of treatment. If further treatment is needed, you need a new doctor’s referral (approved by the chief medical officer if you want a refund).
Treatment usually ends by mutual agreement. In addition, both you and I are free to end the treatment at any time without giving reasons. In particular, I will decide to end the treatment if I believe it is not leading to the desired or agreed result, or if other treatment is medically or therapeutically indicated.
The same applies if I no longer consider the treatment justifiable from a therapeutic point of view or if you do not keep to the agreed payment terms. If treatment ends early, only the sessions you actually attended will be charged. Appointments not cancelled in time are an exception (see above).
7. How do you claim a refund from your health insurance provider?
Submit to your health insurance provider the doctor’s referral that was approved by the chief medical officer before treatment started – with the dates of the completed sessions signed by you – together with my invoice, and ask for the refundable amount according to the provider’s tariff or statutes to be transferred to your bank account or sent by postal order. I can advise you on roughly how much your health insurance will refund or subsidise. Any information about the expected refund or subsidy is subject to the decision of your social insurance provider.
